Where Your Information Is Processed

SpinupWP Inc. is a Canadian company based in Ontario. Our application and its databases run on DigitalOcean servers in the United States. The service providers listed below process information on our behalf, mostly in the United States and in some cases in the European Union or the United Kingdom. Our authorized personnel, including contractors, access information from Canada, the United Kingdom, Panama, and South Africa.

International Data Transfers

If you live in the European Economic Area, the United Kingdom, or Switzerland, using our services means your personal information is processed outside your home country. We rely on the following safeguards.

  • Canada. The European Commission has decided that Canada provides adequate protection for personal information held by organizations subject to the Personal Information Protection and Electronic Documents Act (Decision 2002/2/EC). That Act applies to us. The United Kingdom recognizes Canada on the same basis.
  • United States. Where a provider is certified under the EU-U.S. Data Privacy Framework, and its UK and Swiss extensions where relevant, we rely on that certification.
  • Providers that are not certified, and other countries. Where a transfer needs extra safeguards, we use the Standard Contractual Clauses approved by the European Commission, with the UK addendum or Swiss adjustments where they apply.

Service Providers We Use

We use third-party services to run our business and deliver our services. Some process personal information on our behalf under contract. Others, such as payment providers, sign-in providers, and the services that load scripts and fonts on our website, process certain information for their own purposes under their own privacy policies. We do not use advertising or retargeting networks. These services fall into the following categories:

  • Hosting and infrastructure, including cloud hosting, file storage, DNS, SSL certificates, and error monitoring
  • Payments, tax, and invoicing
  • Email delivery, for account, notification, and newsletter email
  • Customer support
  • Product and website analytics
  • Text messages for two-factor sign-in
  • Sign-in with GitHub, Google, or X, if you choose it
  • Default profile images, using a hash of your email address
  • Company email, documents, and internal communication
  • Scripts, fonts, and video on our website, which receive your IP address when your browser loads them

Data on Your Servers and Sites

Your websites, databases, and backups remain on servers and in storage accounts that you control. When managing your servers, SpinupWP may process information returned by commands executed over SSH. We retain certain command logs and output for operational, security, and troubleshooting purposes. These records may contain personal information originating from your servers and are handled in accordance with our Data Processing Addendum.

You decide how personal information on your servers and sites is used, or you act for a client who does. For that information, we act as your processor or subprocessor. Our Data Processing Addendum sets out our obligations and forms part of our Terms and Conditions.

The cloud server providers, backup storage providers, and Git hosts you connect are your own accounts. They handle your data under your agreement with them, not as our service providers.

Data Retention

We retain personal information as long as it is needed to conduct our legitimate business purposes or to comply with our legal obligations, or until you ask us to delete your data. We keep account information while your account is open. After you close your account, we delete it, except records we must keep for tax, accounting, or legal reasons. Data that we gather for a specific and particular purpose, such as assisting law enforcement or analyzing trends, will not be kept for longer than is necessary for that particular purpose. Data that is no longer needed by us for any of the purposes listed above will be permanently deleted.

You may request that we delete your data at any time. You may request from us a list of all third parties to whom we have transmitted your data.

Security of Your Information

We take all reasonable steps to protect your personal information and keep your information secure. We use recognized online secure payment systems and implement generally accepted standards of security to protect against the loss or misuse of personal information. However, no security measure is foolproof, and no method of data transmission can be guaranteed against interception or misuse. We cannot guarantee complete security of any information you transmit to us.

If we become aware of a personal information breach, we will assess its potential impact and notify affected individuals and relevant authorities as required by applicable law. We will also take appropriate steps to investigate and address the incident.

Children

This website is not designed for use by children under age 16, and we do not knowingly solicit personal information from anyone under age 16. If you are under age 16, do not access or use our website or related products or services. If you become aware that we have collected data of anyone under the age of 16, please contact us so that we may delete that data.

Change Consent: You have the right to change your consent to our use of your information. In such cases, we may require you to delete your account with us, as described above, and you may not have full access to our website.

Request a Copy of Data: You have the right to request a digital copy of the data that we hold about you. Your first request for a copy of your personal information will be provided free of charge. We may charge a reasonable fee for additional copies, or for requests that are manifestly unfounded or excessive.

Transfer Your Data: You have the right to request that we gather and transfer your data to another controller, in a commonly used and machine-readable format.

Delete All Data: You have the right to ask us to delete your data in the circumstances the law provides, and we will do so without undue delay. There are exceptions to this right, such as when keeping your data is required by law, is necessary to exercise the right of freedom of expression and information, is required for compliance with a legal obligation, or is necessary for the exercise or defense of legal claims. Such a request may result in a termination of your account with us and you may have limited or no use of our website.

Object to Processing: You can object to processing based on our legitimate interests. You can object to direct marketing at any time, and we will stop.

Emails and Communications: You may opt out of receiving future email correspondence from us by checking the appropriate box when you register for the account or make a purchase. You may change your communication settings by contacting us at [email protected].

Marketing Communications: You may opt out of receiving any third-party marketing communications or having your personal information used for marketing purposes. You may do this by contacting us at [email protected].

Processing: You may, in some circumstances, restrict the processing of your data, such as when you contest the accuracy of your data or when you have objected to processing, pending the verification of that objection. When processing has been restricted, we will continue to store your data but will not pass it on to third-party processors without your consent, or as necessary to comply with legal obligations or protect your rights or those of others or our company. In addition, you may opt out of any processing of your data altogether. Note, however, that doing so may result in the termination of your account and loss of access to our website.

Complaints: You have the right to complain to a supervising authority if you believe we are misusing your data or have violated any of your rights under this Privacy Policy or applicable law.

Newsletter Privacy

We offer the opportunity for you to volunteer certain information to us that is used for email and marketing purposes. This information includes, but is not limited to, your name and email.

We use that information for a couple of reasons: to tell you about stuff you’ve asked us to tell you about; to contact you if we need to obtain or provide additional information; to check our records are right and to check every now and then that you’re happy and satisfied. We don’t rent or trade email lists with other organizations and businesses.

We use a third-party provider, Drip, to deliver our newsletter. You will have an opportunity to unsubscribe from any future communications via email, but we reserve the right to maintain a database of past email subscribers. We reserve the right to use this information as reasonably necessary in our business and as provided by law.

Severability

If any part of this Privacy Policy is deemed unlawful and/or unenforceable, all other provisions contained herein will remain in full force and effect.

Law and Jurisdiction

This Privacy Policy is governed by and construed in accordance with Canadian law. Any dispute arising out of or related to the information contained herein is subject to adjudication in the province of Ontario, Canada.
